Kathua Rape case-Shaming the country for their personal benefit

It is obvious that there is a network operating in India that is opposed to PM Modi because for the first time in India they have lost the privileges in the corridors of power that they and their peers have enjoyed since independence in 1947. 

They have been desperate fighting for their existence and have been creating all kinds of stories to slander PM Modi and the government. It is increasingly clear that the publicity surrounding the Kathua Rape case was stage managed on a global scale, unmindful of the damage it can do to the image of the country to, to promote the interests of a few.

Kathua Case as it stands now: 1) Lawyer Deepika removed by victim’s family. 2) Talib Hussain accused of 2 rape. 3) Family asking Funds raised by Shehla Rashid. 4) Congress leader Tariq Ali, Businessman Moideenkutty, Bishop Mulakkan who ran Kathua Campaign, now booked for Sexual abuse & Rape.
It was made out as though India was the Rape capital of the world and somehow Modi was responsible for the whole state of affairs. The falsehood that is propagated is documented here.

'Celebrity' lawyer in Kathua rape case attended just 2 out of 110 hearings, removed by victim's family

Advocate Deepika Singh Rajawat, who became an overnight celebrity in media after she appeared as a lawyer for Kathua rape and murder victim, has been removed as an advocate by the victims family.

In an affidavit filed at the Pathankot sessions court by the victim’s father Mohammad Yousaf, who is also the main complainant of the FIR, said Deepika will no longer be his advocate in the case and he is withdrawing the power of attorney issued to her.

Kathua rape case was top news for several weeks in the country, and Deepika was hailed as a hero of the case. It was argued that if Deepika Singh had not joined the case, the victim would have never got justice. And she became a superstar after she got a thumbs up from Hollywood star Emma Watson. In April this year, Watson tweeted “All power to Deepika Singh Rajawat”.

Deepika also had won the ‘Woman of the Year’ award by the Indian Merchants Chamber of Commerce & Industry Ladies Wing.

Now it has come to light that Deepika has attended only 2 hearings in the case that is being heard by Pathankot session court, according to the affidavit by Yousaf. Sessions Judge Dr Tejwinder Singh is hearing the case on a daily basis as per Supreme Court order, and a total of 110 hearings have taken place already in the last five and a half months. But the celebrity lawyer, who was supposed to lead the fight for justice of the victim, attended only 2 of these hearings.

According to Yousaf, Deepika Rajawat says she has a threat to her life in Pathankot, that’s why she does not go there for hearings. In view of this, Yousaf informed the court that he is removing Deepika Rajawat from the case.



It is interesting to note that when the Supreme Court had transferred the case to Pathankot, Deepika had projected it as a victory for her. The victim’s family had requested for transfer of the case from Jammu and Kashmir, fearing threat to the family, a friend, and lawyer Deepika Singh Rajawat. After SC had accepted that request, Deepika had told media that they are happy with the decision and said that ‘now Justice will be done to the child’.

She had also expressed her happiness at the case being transferred to a ‘safe and peaceful’ place and thanked the top court for the same. But it seems due to some reason, Pathankot suddenly became unsafe for her, but the victim’s family didn’t feel any threat as they are attending the case.

Talking to The Print about her removal from the case, Deepika said that the case is handled by two very senior lawyers, and they have far more experience than her, hinting that she is really not needed in the case. She also said that it is not possible for her to go to Pathankot every day as it will affect her practice and she also has family responsibilities.

It may be noted the Kathua rape and murder case is a criminal case, and as per law, the state fights the case against the accused. The victim need not appoint any lawyers. But often victims choose to engage private lawyers if they feel that the public prosecutors may not be able to present the case properly. But even in such cases, the private lawyers work only as assistants of the public prosecutors, they can’t work in the case independently.

Mohammad Yousaf retains his other private advocates, K.K. Puri, Mubeen Farooqi, Pankaj Tiwari, Vishal Sharma, Pankaj Kalia, Joginder Singh Gill, Karanjit Singh, Sourabh Ohri, Varun Chib and Harwinder Singh, who are assisting the designated government lawyers.

This is not the first controversy associated with the fight for justice to the victim of the crime. After the incident had come to light, left Wing activist Shehla Rashid had collected funds for the legal aid of the girl, and she herself claimed to have received more than ₹40 lakh from donors. But according to reports, the victim’s family didn’t receive any of this fund. The family was having to sell livestock to provide for travel expenses to attend the trial at Pathankot, the reports said.

After Shehla was bombarded with questions on Twitter after these details came out, she deleted her Twitter account.



Earlier, advocate Talib Hussain, who was a prominent activist demanding justice for the victim, was accused of rape by two women. He is also accused of domestic violence and attempt to kill his wife over dowry.

As per a report on News18, the family of the Kathua rape victim is forced to sell off their livestock to pay expenses of travelling from Kargil to Pathankot, where a trial court is hearing the matter.

“I had to attend court three to four times. Each time I had to travel, I sold some of my sheep and goat to pay for the expenses,” the father of the victim said but insisted that he will even sell his property without any hesitation if needs be. “I will fight this case till the end,” he said.

As per a report on The Tribune, the family of the victim has also demanded details of the funds collected for them during a campaign run by social activists in January this year. “We have information that lakhs of rupees were collected from different parts of the world by exploiting the incident by some people,” the report quotes the grandfather of the victim as saying before adding, “Those who were in the forefront to ensure justice are now even hesitating to attend our phone calls.”

“After reaching Samba, we tried our best to get details about the funds collected during the campaign but to no avail due to the evasive attitude of the so-called crusaders,” the report quoted the biological father of the victim, “Those who had promised to provide every possible help to us six months back are pretending to be busy with other ‘important’ work.”

We had earlier reported that a leaked audio tape had emerged which suggested that the huge sum of funds collected in the name of the victims’ family never actually reached them. In the tape, two people are supposedly heard discussing how “huge funds” were collected in the rape victim’s name, which never made its way to the family.

Leftist JNU activist Shehla Rashid had claimed that funds of over 40 lakhs had been collected from donors. She had later also stated that the lawyers are not charging money and hence a sum of rupees 10 lakhs will be handed over to the rape victim’s family.
Media reports had claimed that though lakhs of rupees were collected in the name of helping the family, the funds never reached them. Reports stated that the JNU student union and many online ‘activists’ who had campaigned for the Kathua victim had never bothered to hand over the funds to the victim’s family. Rashid had denied the allegations and later stated that the money was delayed because the family did not have a joint bank account and PAN.

It is notable here that one of the main activists of the campaign, Talib Hussain, was later arrested on rape charges and was sent to jail.

Update: Shehla Rashid, the leftist student leader who was actively involved with the fundraising has denied the Tribune report. In a Twitter thread, she has asserted that the report is false and that she had met the family personally and none of them had any complaints.
The journalist who reported the story has, however, stood by his report. He has asserted that he has a recording of the conversation with the family of the victim.
